[2:42:13] Town Treasurer: I'm your treasurer, and I'm proud to be it, but you may not like me when I tell you some of the things we've got today, but most of them are good. As of the 21st, we're coming to the end of the third quarter with these warrants that they're signing tonight. Your expenditures right now are 67.40% and we have 14 more weeks to go before the accruals. The detailed reports will be issued next week because both the month and the quarter both end. And then we have the totals of all the accounts at this station. You folks have your reports in front of you as well as the money that's in the accounts as of right now. And I dealt with the bank the other day and got the interest increased on our CDs, two of them, and they're put in into a shorter term so we can get more interest for them once they decide what you're going to do with them. Could not get any more for the rescue billing, as you know, when it came, they gave me a hefty increase because as of right now, we got $16,000 in interest this, and your franchise The franchise fees are $23,000, almost $800 as of right now. You still have another quarter. There has been an issue with the Maine PERS, but it has been corrected and posted up to date. MRI, the prior payroll company that we have been working with, dropped the ball back on June 30th when their representative resigned and never bothered to let us know. They locked the system out and put it digital, and Maine PERS, their officials, had to open up the program, and it took over a day to get it done. Once it was over, the two mission missing months have been brought up to date, and going forward the payments will take be taken care of here in-house. Don't think you've got too many questions that you need to ask on the payables, on the expense report, revenues and general ledgers. The bank accounts are balanced up to the month of August, and I might bring it to the board's attention that the bank accounts are supposed to be reviewed, and they're presented for review, and they're always been accessible. Gil was the last one to review them. I have mentioned it, but it didn't seem to be an issue, and it fell kind of, I guess, on deaf ears, but they are available, and we've been working very closely to make sure that they are up to date. Sue has done an amazing job. She's my deputy, and we're both sworn in, and she works very diligently, more than two hours a week, as was earlier stated. And thanks to her, we found some errors THAT DUE TO MY PREDECESSOR AND WE BROUGHT THOSE TO THE ATTENTION OF THE BOARD AND TODAY I HAD THE OPPORTUNITY TO SPEAK TO JUSTIN BERG AND I GOT HIS AGREEMENT THAT WE'RE LEAVING ALONE TILL HE COMES IN TOMORROW HE SENDED ME AN EMAIL WITH THE REPORTS THAT HE NEEDS AND SINCE THERE'S BEEN SO MANY PEOPLE DOING and journal adjustment entries for 23, 24, 22 that he wants to get together with me and we're gonna go right back and start so we know where we're standing for 25. When I saw this one journal was what they call a B, and that's for a budget adjustment that is figured by TRIO and brought across for us. and it affected all of the designated fund balance or special revenues which were for your do to do from accounts number journal number three and for the expenditures so that your water projects and that's your fire barn and in this then they made a decision to reverse the journal entry. Unfortunately it was done in manually, it was not done through the budget beginning balance figures, so currently sitting out in the accounts there is a beginning balance journal entry and a regular reversal entry That are invalid. They were supposed to be reversed, and I'm sorry that this didn't find, and this would have probably not happened if I had been allowed to have an audit as I had asked for when I was first elected. And the state says that I'm entitled to it because of the year my predecessor had been here, and to make sure that the books were in balance. But needless to say, it wasn't done, and it's cost the town Limerick, I'm very sorry to say. I have to hunk in your auditors fees. I'm very sorry, but I had no control over it. Handsforth going forward with Mr. Burg, I hope that I can keep my promise to you folks, and that your balances, your budget will be balanced. And if you folks need to see any of these reports, you're more than welcome. This is what is being texted, emailed to Mr. Berg, that's since the fire barn started to date, and that journal, that account was only in balance for three months up to 2023, and that's when those three journals were made, and it got worse from there. And on top is also where the warrant article, a special town meeting back to November 8th of 2022, just about opened up your accounts to be a piggy bank for anybody to spend whatever they wanted in the transferring of money. Thanks to Judy Page, I was given this, and so because I had never seen this report before, and it really did, you could move anything any way you wanted it and spend it what you wanted as long as it went to the fire barn. But we will get this solved with a new auditor. He hopes to be, as I said, I will have literature from him tomorrow morning and know what I have to get to him. I will forward all the copies of everything to the board, which would be standard operating procedures, and go henceforth and keep the public and everybody in tune of what is going on. I also like to bring up that two months ago here in a meeting I asked for a meeting with members of the board to get the correct postings for the tax acquired properties. To this date that has not happened. Currently we have six properties that have been sold in the excess of three hundred and seventeen $17,000 that was requested by both Judy and I to happen, and we'd really like to get it. We've only got one quarter left, but you've got more properties. I know coming because I watched the meetings and we would like to make sure that this is coded the way you wanted before the year-end. In regards to daily operations, I would like to ask in the future following that all the invoices are given to the treasurer's office or laid on my desk and each of the invoices should have a PO attached and to the account numbers that they're to be charged. This is in the SOP for the new purchase order policy. I'm just asking so that it starts to become secondhand. I only have a few that aren't doing it, but that can be easily rectified. Sorry, I've got quite a bit here to bring forward to you folks. I would like to ask again that I know it's a lot, not really a lot to ask, but I'm asking that I be on the email to get the corrected or when it's finally signed for the minutes and also the agendas, please. It was just by the grace of God because I was figuring one more week before I had to make this report, so it's a little bit all over the place. But I'm going to bring this subject up because I see that it's on there. You have stated that at the last meeting that you could touch the Treasurer's Budget. Well, Dean LePage was spot on. You can't because of the way we do it. MMA says you can't as well as Maine state government and the bookkeeping practices because it says, like most traditional town halls, Limerick public votes on a budget via the warrant articles at an annual or special town meeting. THE STATE STATUTE CONTROLS ONCE VOTED ON THE EXPENDITURES OF THESE FUNDS IS LEGALLY BOUND BY THE MAIN MUNICIPAL FUNDS LAW. MUNICIPAL OFFICES, THE SELECT BOARD AND THE TREASURES CAN ONLY SPEND THE MONEY AUTHORIZED BY THOSE SPECIFIC VOTERS APPROVED WARRANT ADDICALS. AND IT GOES ON TO SAY MORE, AND THAT'S RIGHT, EASILY ACCESSIBLE ONLINE AT THE MAIN STATUTES and MMA as well as the duties of the treasurer I don't want to really get into that tonight but I am doing my job I could be easily handled a little bit better if I got to get some communications I don't get to speak to any of you folks very often and it seems like I've I've got the plague and I don't, I'm working for you folks and I made promises to some people in this room that I had their backs and I don't make that very likely. My word means something and it always will and I promised the voters that I would get them a balanced budget and with Mr. Berg's help we will have it before my term is done because he's already shown me and we've talked about some stuff that's never been brought up before and I'm very impressed and he was with what I knew about the systems and the backup materials and the following of the gap c34s which are the standard government accounting that which is not like your normal bookkeeping process it's a lot different and has to be followed by the guidelines of it or there are substantial penalties there was a comment made and i heard it so i that kind of opens the door when they were smart chuckling about the wall in regards to the wall it might be politic would might have been politically correct to speak to the departments that it would be affected when you put up a wall to make room for someone and Would you add do this with in the library the transfer station the town clerk's a tax collector's office or in the fire chief's office? Currently it takes less and 10 steps thereabouts up to 15 to go from my office to Courtney's and we are in communication with a lot during the day passing paperwork back and forth if you put the wall in as you are looking to do, that will create a 72-foot passageway that has to go to be done and takes 52 steps to go one way. So that's 104 versus 32 and two, three doors to go through. There are 11 files that will not be accessible by the treasurer office. they will no longer be available because you're going to have a wall and my office will the treasurer's office will be located on the wall farthest away from these filing cabinets also I found out that a lot of people didn't even know that those were for the treasurer and the tax collector that is where you file your documents for your liens your foreclosures your discharges without those, if you could ask the manager, I don't know what you gave him for a title, but he's doing a good job on the fact that sale of property, you're supposed to have every document in their file from the first time that it was leaned on, right up to the sale. And if you don't have that, the owner in one piece is missing or a signature isn't there, then null and void. And this is, I know this because of what I have gone for classes, they're available for the tax collector and the treasurer of all the time on liens and foreclosures. And it might be feasible if some people, other people in the town took them, or even read the documents on them. If you put a walk, still want to pull a wall up, and I know you do, I would make the recommendation of putting your wall way you want, but make it with a door in it with a deadbolt on the treasurer's side if you're worried about the treasurer, and that way we're not walking that fire, Courtney and I can communicate with each other and give back and forth. You've got your privacy on both sides and it be locked up, but if you put a solid wall up there, you are going to sufficiently damage the work ability to do liens and foreclosures in the treasurer's office, and without your treasurer you don't have your foreclosures, that's a state statute. And currently as I said there's 11 files in that alcove and two more on the outside that would be moved, the other file is Courtney's, and then it's arts. We all need exercise, but you don't need it that day and day out to do that. And I'd also like to apologize to the people because I've heard some comments, and I'd like you to know as of right now nothing is broken, just badly bruised. Two weeks ago tomorrow night I fell down the back stairs, Judy and Dee were gracious enough to help me get picked up in the interim. Thereafter I'm getting side effects from my shoulders and my knee and my back, but I am in here working every day and it's not, no it's not affecting me, it's just like when I broke my back I was supposed to be out for four months, I was out 29 days and I worked from home. It was one more, I'm sorry, but I think you know with the door it would be nice rather than a solid wall, there's no need of the aspects of that. And I'm looking, as I said, looking forward to working with your new auditor. I took it upon myself to introduce myself to him because I needed to know what to do with that three accounts, three entries that I found, because that affected all the way back to, I said as 22, 23, 24, because the money started, it was fine in 21, 22, and then in 23 that entries was made and I cannot follow where everything is as of right now. I'm trying and hopefully with Mr. Berg's help, we will get it done. And when you got main purse, but I want to thank Dean. He was spot-on the idea of the, you couldn't spend the, but it's because the way that the town does their voting, they could take the money away, and they did take it away. And I'm still working on helping in the side reviews with payroll, whatever becomes of it, but I got your main pers straightened away, and we have a labor thing, and I'm getting that straightened away for you folks, as well as the coding and information for the new payroll company. When I stated that I don't do the payroll, I essentially wasn't fortunate, but with the system that we were using, it was just a minor statement. I apologize and bringing that I one last thing and this goes back to the match election many of you know that I was not there was not by choice I would we had a meeting of the budgets beforehand and I expressed everything and brought it all down and I was there after the meeting broke up was asked not to attend the meeting. They were in hopes that it might be quieter. I saw the meeting. I couldn't get there in time. I apologize. I will not miss another election for you in my term. But I specifically was asked not to attend by a budget member and a board member. And I'm not saying names and it's nobody's business. It's in the past. But I don't want to be blamed that I was a coward not to show up or anything. I was asked not to attend, and what do you do when officials ask you? Usually try to facilitate what they ask, and I did, and it cost me a hell of a lot of money. So but other than that I'm here doing your job and doing it to my best ability and doing it the right way the way the law states. They actually altered the sidewalk and added a walkway, which again, created a biased and unfairness. So it was in the road traffic safety ordinance, which has now been updated to reflect everything. So that will be addressed later. Okay,

All right, we'd call her up and say hey can we have can we have this date, can you put it in the paper? All right, can you call Gail? That's the central thing. All right, there again volunteer people doing a job for no pay. It's been going good for 20, 25 years. All right. And we would ask they would make copies of the five of us when we come in. So I think you guys got to think about saying that Courtney's not going to help the appeals board because if that's the case, come budget time, we might as well put $50,000 dollars in a budget so they can have a full-time secretary. We had a secretary very minimal. The only thing a secretary did was did the minutes to our meeting. Okay, that's traditionally it's all it ever was. They weren't all the time there and I don't think last year we had a meeting. All right, so it's kind of pointless to put somebody on a payroll for that so i think it's something to rethink i know she's your secretary but we was always the town administrator to help out you know and something like that because that 's a lot of work i've done it plenty of times michael carroll dave coleman you know reams and reams of paper we're running through our copiers and that shouldn't be all right it's an appeals board for the town of limerick all right there should be some help in doing i'm not saying overextend help but you know if somebody's here all day versus the Appeals Board people that are working, right? The Budget Committee, we always relied on the Selectmen's Secretary to print out stuff for us for 20-something years, okay? I think we just got to re-get in the sight here of what the Appeals Board, what the Budget Committee are. Either that or you stop paying them. And even if you're going to pay them, they're going to have to have a copier. So can we buy a copier just for the Appeals Board?

Okay, I went back through all the records here, we've used four different lawyers on the appeals board, okay, six years ago we couldn't have the town one because the planning board had the town one, all right, so it's all documented, we were told go hire a law firm, okay, and then there was another time we had the town's lawyer, the planning board had to go get another lawyer, and then it was the other time was Mike Gilpatrick, that he had the town's lawyer, planning board had to get a lawyer, and we had to get a lawyer, all right, unforeseen circumstance, so that's just something to keep in mind, this stuff has been going on and on and on, and it's whoever asked first, whatever board asked the town's lawyer, that's who gets them, okay, and that's that's just the way it is, so keep that in mind on at this

And I also had a couple of questions about the pavilion, what's going on with the pavilion. I understood that was all ready to go and then nothing's happened.

Install the nets and tensioners to make the court at least playable, and it can be revisited in the spring for more permanent solution. John is willing to donate the sport court tape. The only caveat is that he would like it done under the rec department. Department and all the people used would be volunteers of the town. And him nor anyone else will accept liability or receive any compensation for this.

The last few weeks, everybody's been, you know, Courtney's been trying to get all this to the people, then the payroll company, they even asked for more. Why did we ever take it out of house? You put your time cards in, you get your paid and, you know, there was never a discussion about it and it seems like that's all we talk about is getting the payroll straightened out.

I have to answer for the books and if you don't believe me you can ask your new auditor. I'm just afraid for the town if you want to set yourself up. I mentioned to all you folks earlier and I know I get all sorts of strange little faces, if you postpone this to start them with the new budget for 27, all right, you have three months. I'm not going to run away and die, I hope, unless I fall down the stairs, maybe I'll break my neck and make everybody happy, just kidding Julie, no I said I'm just kidding, okay we're just relaxed Laurie, that's not funny, well it is because I hear it, all right, all right, I'm not going anywhere, but anyhow what I see is you're looking to bring Somebody in to learn trio that isn't the most user friendly. The classes aren't as good as they've made to be. Then you've got to get them state certified so that they know what the job is. I don't want the job if you don't want me here, and that's fine. But I am willing to give my expertise and training and being on a state board for the Maine Municipal Association for 10 years and helping train of everybody in the state of Maine. I have volunteered to help. I see the faces that are being made and I don't appreciate it, but I mean it. Why waste your money if you've got somebody in here that's offering to help train somebody? Bring them in when the books are balanced. They're not now, and they're not going to be able to play with them. They can set up the trio system like we did here when Judy and Dede and Anastasia set it up. There is a program to learn to play on it. But that isn't the most useful part of it because I tried it. I'm not trying to be disrespectful to anybody. I want to see this town succeed. I'm sick of working, but I'm working because I made a promise to the public. And I'm doing my job, and I'm doing it quite the right way, whether anybody likes it or not. But as I stated before, I'm not going to jail for anybody. But you read your state statutes and see what it says. You can't take the treasurer's money, that's in the state statutes. You've already taken twelve thousand two hundred from it. There isn't any more left. That's my treasures and me and our training. Then you, there's nothing in there says about a bookkeeper, and if you don't have that, then you can't touch that money. And that's my understanding, that's right from Augusta and I because I asked the auditor up there, and if it's documented and I've got it on my phone, I took pictures of it and sent it, and I'm not, I'm not looking to be patted on the back. I want to see this town succeed because I've listened for over 20 years of the mess that the water berg limerick books were in, and I saw the fear that was in Laura maze because we have a webmaster that they send out questions once you remember and the whole state answers to it. And you can ask Wade. I asked him if he had any, she had any training. And I said, read the charter, read the books that we have. And you can ask him, I'm not lying, didn't I, Wade? And some of the questions were black and white. And now I'm seeing why. I don't know what the problem was. Laura May knew the laws. I was very honored to work with her and to be with her. But we're seeing everybody makes mistakes, we're all human. I don't have wings and I don't want any for quite a while, but I am willing to work for this town and help you get where you want to be if you want me to. But there's no sense of paying somebody to train somebody that doesn't have a clue what they're doing on TRIO. That's your main lifeline.

[3:48:01] Speaker L (unidentified): These chairs, like sitting in the church, so the getting back to the road safe traffic road safety ordinance, which was enacted in 2023. The main reason was is because there was contractors damaging roads, and we need to clarify the responsibility of contractors and independent people damaging the roads. The towns and municipalities are not obligated to pay for the damages. People doing work are liable and responsible. It also clarified the sidewalks, crosswalks, which Main Street was all redeveloped by Main dot. They still have not put the crosswalks in and the signs in that they need to do. We have a continuing problem with the duncan crosswalk, and it is blind during bad weather, so we're addressing those. The issue with duncan wasn't duncan themselves, but the engineers that developed the concept plan presented to the town a whole different picture without presenting a final plan. So when people looked at a concept plan, which you can see one there for a parking lot along the wall, it was very colorful. It showed granite curbing. It showed concrete sidewalks. It did not show any mailboxes, which under federal USPS standards, a mailbox or any other obstruction cannot be in the sidewalk without a three-foot clearance. So what happened is to try and accommodate and quiet people down in the rush to get the sidewalk in, because the contractor was the developer was paying contractor rates on a loan, the choice was either get the sidewalk in or we weren't going to allow dunkin donuts to open for another year. We were hoping to work with the water district at the time. We were going to put the monies in escrow, the monies that was an escrow, and the cost to do the project at that time would have paved a pocket area for the ballpark, it would have paved for paving that's park street, which the town did anyway, and the paving or the concrete work for the sidewalk. It didn't work that way because the water lines and the sewer lines didn't fall into place, and there was a hiccup, and i believe, and i can be corrected, that grant was denied because of a timeline or something, so that didn't happen. The sidewalk went in, the cards put the sidewalk in, and when they put the mailbox in, which wasn't supposed to be there, i think Howard and Bernie and John and I, along with Maine D.O.T. and a representative from Duncan, were there. What they did is they altered the width of the sidewalk to accommodate a three-foot area around the sidewalk around the post. They also widened the walkway to the individual's home. So when they do it again this year, they cannot widen or alter the sidewalk. It needs to go back to its original width as designed. In this, it just, what I did is as I updated it, and it needed to be updated because you did a new winter closing list last year. That list was incorrect with some of the information it was on it, nothing critical, but this will supersede it, and it already had it in it, but it gives the correct points of where you plow to because we haven't reached extending any more of the plow points yet. This does explain by UPS main DOT standards that no obstruction can be placed in the sidewalk without a town official or the road commissioner's guidance or authority. Authority. So that's what it did. It starts on page eight of what I presented to you. The homeowner was given the letter and I did meet with him in August of last year. I sent you a copy of that letter. But if the mailbox was knocked over or removed, it cannot go back. It is an obstruction. It's a visual obstruction, especially for people crossing the road, and you just can't have it, as well as the hazards with snow removal equipment. As much as we'd like to say we can maneuver them and get around them, it is another obstacle. So that is what this is. This little blue tag is where it starts with the revised amended section, and the signature page for the select board is in the back, and it then it can be attested by the clerk, but the select board has in the past voted on this in previous two previous times, June 20th of 2023, revised August 12th to 2024, and now this would be September 22nd 2026 if you decide to vote and approve. If you go towards Stevens on that end, on the west side, you know, we were out there looking at that, how the driveways we had a tree that was questionable would probably come down right there's two houses across the street well the one thing i don't know is what's the difference in elevation from where the lowest part of that ditch is causing the problems across from lovelies and if we go up that route i believe that trip that empties down on his land in that gully There's a little roadway past Rogers heading towards Stevens, and I'm wondering if by putting a large culvert in there, something that's a fairly good size to take the water, that we could dig down and carry the water down to that end, as opposed to going down in front of where all his gardens are, which would have to put in a stump, some kind of a tank, and then pipe it. And from what the last discussion I had with Roger, which was a couple of weeks ago, he was saying that the people that abut him on the east side said that they would allow water to be drained around the property. Now, I haven't talked to those people. I don't know that. But I think we really got to look at it, because that telephone pole, if you go any digging any close to it, that's going to come down.

I don't see any erosion, but I don't have a problem rebuilding that retention area, excavating all the dirty material up putting some fresh stuff in there and if you if you keep it clean there's one on Pickle Pond that's been there for 30 years there was a huge puddle beside the road no place for the water to go they excavated the ditch they built a dry well to this day it still works if the debris and the leaves and everything can stay off the top of it 'll work effectively it's one of those things where you've got to keep it clean you just in the fall you've got to rake the leaves off it 's a maintenance thing it's like a dirt road a dirt driveway you got to keep up with it this is a drainage issue and you're right I tried to we tried to resolve the problem I get yelled at I walked away it's like I don't have a problem helping you out Roger, I don't have a problem with that. I'm not gonna, I don't think digging 150, 200 feet inside the road is gonna solve his problem.
